MusiCurate App Terms of Service

These terms cover the MusiCurate mobile app. Purchases from our online store are governed by the store terms of service. Une version française complète et équivalente est offerte au lien ci-dessus.
These terms are an agreement between you and MusiCurate Inc., an Alberta, Canada corporation, and they govern your use of MusiCurate. By using the app you agree to them and to the App Privacy Policy.
Who can use MusiCurate
You must be at least 13 to use the app. If you’re under the age of majority where you live, a parent or guardian must review and agree to these terms on your behalf. Some material (the interactive fiction and novels) contains mature themes and is gated to older users; by opening it you confirm you meet the stated age.
Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use MusiCurate for your own music learning, practice and performance, subject to these terms.
Your account
You can use much of the app without an account; creating one enables cross-device sync. Keep your sign-in credentials secure: you’re responsible for activity under your account. Tell us promptly at music@musicurate.com if you suspect unauthorized use.
Subscriptions, trials and billing
Some content requires a paid membership. Subscriptions are sold through your Apple App Store or Google Play account and renew automatically each period until you cancel. Cancel at least 24 hours before the period ends, in your store account settings; the store processes the renewal charge. If a free trial is offered, it converts to a paid subscription unless you cancel before it ends. The price, billing period and what each plan includes are shown before you purchase. Refunds are handled by the app stores under their policies, and nothing here limits refund rights you have under local consumer-protection law.
Licensed content and intellectual property
Courses, articles, recordings and sheet music in the app are provided under licence for your personal practice and performance within the app, and remain the property of their owners. You may not redistribute, resell, extract or share them. The bundled instrument sounds come from permissively-licensed or public-domain (CC0) sources, credited in Settings, under Acknowledgements.
Content you create or import
Annotations, setlists and scores you create or import remain yours. You’re responsible for having the rights to any sheet music or images you import or scan. You grant us the limited licence needed to store your content and, if you sign in, sync it to your account on your behalf, and nothing more.
Acceptable use
Don’t copy, extract or redistribute licensed content; don’t reverse-engineer, tamper with or disrupt the app or its security; don’t use the app to infringe others’ rights or break the law; and don’t misuse community or sharing features.
Showcase and community
The showcase is optional and you control its visibility within the limits set by your age. Don’t post infringing, harmful or unlawful content, and don’t impersonate others or use a display name that misleads. We may remove content or restrict sharing features that break these rules.
Copyright complaints
We respect the rights of composers, engravers, publishers and authors. If you believe content available through the app infringes your copyright, email music@musicurate.com identifying the work, where it appears in the app and how we can reach you. We follow Canada’s notice-and-notice regime: we review claims, forward notices where the law requires and remove or disable content we host when a claim is substantiated.
Disclaimers
The app and its educational content are provided “as is” for general learning, not as professional or medical advice. We work to keep the app accurate and available but don’t warrant that it will be uninterrupted or error-free. Some jurisdictions imply warranties that can’t be excluded; where that’s the case, they apply to the extent required.
Limitation of liability
To the fullest extent permitted by law, MusiCurate Inc. is not liable for indirect, incidental, special or consequential damages arising from your use of the app, and our total liability for all claims connected to the app is limited to the greater of the amount you paid us in the 12 months before the claim arose and $50 CAD. Nothing in these terms excludes or limits liability that can’t be excluded by law, including rights under Canadian consumer-protection legislation.
Indemnity
You agree to indemnify MusiCurate Inc. against third-party claims that arise from content you import, scan or post without the necessary rights, or from your use of the app in material breach of these terms. This obligation doesn’t apply where prohibited by law and doesn’t limit any rights you have as a consumer.
Termination
You may stop using the app at any time and delete your data from Settings, under Account. We may suspend or end access if you materially breach these terms.
Changes to these terms
We may update these terms as the app evolves. We’ll post the updated version and, for material changes, notify you in the app before they take effect.
Governing law and disputes
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta have jurisdiction over any dispute we can’t resolve informally, and both sides attorn to them. If the consumer-protection law where you live gives you the right to bring or defend a claim at home, in your own language or under mandatory local rules, nothing in this section takes those rights away.
